The Independent National Electoral Commission’s discretion to choose the method of election result transmission for the presidential election held on February 25, 2023 has been upheld by the Presidential Election Petitions Tribunal.


The five-member panel, presided over by Justice Haruna Tsammani, cited Sections 52 and 65 of the Electoral Act 2022, which gave INEC the authority to specify how election results would be communicated throughout the vote.


The petition, filed by the Labour Party and its presidential candidate Peter Obi, seeking to void President Bola Tinubu of the All Progressives Congress’ victory on the grounds that INEC’s Results Viewing Portal had allegedly “failed” to electronically upload election results in real time, was dismissed by the Tribunal.
